The following Terms & Conditions do not affect your statutory rights.
Special Customer Terms & Conditions
Any customer’s orders containing special conditions will only be accepted by Phoenix Healthcare on the understanding that they do not conflict or vary, from our own Terms and Conditions of Sale.
Carriage & Packing Charges
Carriage will be charged on all U.K. deliveries at cost, unless prior arrangements are agreed with Phoenix Healthcare Products in writing. All claims for transit damage must be made within 7 days of receipt of goods.
Prices
Prices will be maintained according to current lists, for as long as possible, but may be subject to change without prior notice. Prices charged will be those ruling at the date of dispatch and strictly net.
Value Added Tax
All prices quoted are exclusive of VAT which will be charged, where applicable, at the time of dispatch. Exemption claims must be supported by appropriate written certification, at the time of order.
Settlement Terms
Payment terms on all orders processed, within the U.K. are strictly 30 days from invoice date, (This is not applicable to the public. Trade only.) at the discretion of Phoenix Healthcare.
Interest Charges
The company reserves the right to charge interest, on overdue accounts, at a rate 3% above U.K. bank base rates.
Reservation Of Title
Ownership of goods and right of title to those goods will not pass to the purchaser until the invoice is paid in full.
Return Of Goods
All returns for credit must be previously agreed in writing. Please contact our customer service dept who will advise you in the correct procedures for all return items. A re-stocking charge of 20% of the value of the goods may be charged. It will be the customers’ responsibility to return the goods at their expense within 10 working days from the invoice date. All returned goods must be in the original packaging, clean and unused.
Cancellation Of Orders
Cancellation of orders must be notified to the company in writing and only with prior agreement of the company.
Service Contracts
Phoenix Healthcare reserves the right to cancel a service contract at any time giving 60 days’ notice in writing
Catalogue/Brochure Illustrations & Descriptions
Every care has been taken to ensure that descriptions and illustrations are accurate in all of our literature, although this information is only issued as a guide the identity of goods, and slight product changes may be made, without prior notification to the customer
Delivery Dates
The company will provide customers with estimated delivery times, but cannot accept any liability for failure to achieve these delivery times.
Hire Machines
All hire machines remain the property of Phoenix Healthcare Products Ltd. If any damage occurs whilst the machine is on hire or if the machine cannot be recovered from the hirer, repair charges or the full cost of the machine will be charged to the hirer. The hirer will also be responsible for the return of all accessories any accessories missing will be charged to the hirer. The hirer will also be responsible for repackaging the
CPM machine and the accessories in a responsible and reasonable manner.
CPM Hire is based on a weekly hire charge and refunds will only be given for whole weeks when returning the machine early.
Phoenix Healthcare will endeavour to repair or replace faulty hire machines as quickly as possible. Phoenix Healthcare cannot be held responsible for any medical problems which may occur as a result of not being able to use the hire equipment.
Warranty & Service
All Phoenix Healthcare Products are subject to a minimum warranty/guarantee of one full year, from date of invoice. All second-hand equipment sold carries a six-month warranty. Any claim must be submitted in writing, whereupon at the company’s option, goods may be repaired, replaced or a refund given, dependant upon satisfactory evidence that the goods are faulty. No liability can be accepted for consequential damage, injury or loss of revenue, arising from defective items. Phoenix Healthcare employs qualified and fully certified field service engineers to maintain all Phoenix Healthcare Products. All machines sold to trade, warranty is return to Phoenix Healthcare Products. Phoenix Healthcare products will not be liable for equipment failure or accidents which occur due to the extreme age of equipment which is serviced or equipment that is being used after the manufacturers recommended date of replacement. All warranties for new equipment are linked to the manufacturer’s warranty. We strongly advise all items of electrotherapy, shockwave, gym and isokinetec equipment are serviced by Phoenix Healthcare Products Ltd
Specialist Shockwave Warranty
Gymna Uniphy Shockmaster - The warranty on the Gymna Shockwave Gun is 12 months or 3 million shocks whichever comes first. This does not include bullets and barrels (Revision Kit). Please note - the bullet and barrels must be changed every 1.2 million shocks – failure to do so will affect the warranty.
Enraf Nonius Endopuls 811 – The warranty on the Endopuls gun is 12 months or 2 million shocks whichever comes first. Please note the heads must be tested with the supplied measuring gauge on a weekly basis.
Loan Equipment
Loan equipment for non-warranty and warranty items will only be provided at the discretion of Phoenix Healthcare. Phoenix Healthcare cannot be held responsible for any loss of income incurred by the physiotherapist whilst equipment is being repaired or in transit
